DECISION AND ORDER REMANDING CASE


This case was initiated by an unfair labor practice charge filed on June 10, 1998, by the American Federation of Government Employees, Local 3475 (AFGE Local 3475), alleging a violation of section 7116(a)(1), (5) and (8) of the Federal Service Labor-Management Relations Statute (the Statute), by the U.S. Department of Housing and Urban Development, Louisiana State Office, New Orleans, Louisiana (HUD). A Complaint and Notice of Hearing was issued on September 30, 1998, and was later amended, alleging that HUD failed to supply requested information and to properly respond to the request for information.


A hearing was held on December 16, 1998, in New Orleans Louisiana. At the close of the hearing the General Counsel of the FLRA moved to remand the Complaint to the Dallas Regional Office of the FLRA for disposition based on the parties settlement agreement. All parties executed the settlement agreement and joined in the motion to remand the case. The settlement agreement, as represented by the parties, appears to the undersigned to effectuate the purposes and policies of the Federal Service Labor-Management Relations Statute. Accordingly, remanding this matter to the Dallas Regional Office of the FLRA for disposition is appropriate. It is therefore,


ORDERED

Pursuant to section 2423.31(l) of the Rules and Regulations of the FLRA, 5 C.F.R. § 2423.31(l), that this matter is hereby REMANDED to the Regional Director of the Dallas Regional Office of the FLRA for further action consistent herewith.
