No Quorum FSIP Case Processing
Federal Service Impasses Panel (FSIP or the Panel) Case Processing during the Time that the Panel Lacks a Quorum
1. How are Panel members appointed?
The President appoints the Chairman and Members of the Panel for staggered, five-year terms. See 5 U.S.C. § 7119(c)(2).
The positions of the Chairman and Members of the Panel are currently vacant.
2. What is the impact of a lack of quorum on FSIP operations?
The Panel currently lacks the authority to issue any decision – including determining whether to assert or decline jurisdiction over cases and issuing decisions to resolve parties’ impasses – as that requires a majority vote of a quorum of Panel Members.
3. What will happen to requests for assistance submitted to the Panel while there is no quorum?
While the Panel cannot issue any decision while it lacks a quorum, Panel staff will continue to receive and investigate requests for assistance filed by parties.
4. How will the parties know when the Panel has a quorum?
We will post information on the FLRA website and issue a press release announcing the appointment of any new members of the Panel. Panel staff will also communicate directly with parties with pending requests for FSIP assistance.
